Order Care is an order-status display service that operates on behalf of participating merchants. Order Care is not the seller, merchant of record, or shipping carrier for any purchase. Information displayed falls into two categories: (a) confirmed order data — order number, order date, items, and shipping destination, as provided by the merchant's order system; and (b) estimated status information — projected fulfillment and transit stages based on typical shipping timelines supplied by the merchant. Estimated stages are provided for convenience and expectation-setting only, are not live carrier scan events, and do not represent the physical location of a package unless accompanied by a carrier-issued tracking number. Carrier tracking details, when issued, are displayed as received. All questions regarding orders, refunds, and disputes should be directed to the merchant. Nothing on this page modifies your statutory rights, the merchant's refund policy, or your rights with respect to your payment provider.
All content on the Service, including estimated delivery timelines, is provided for general informational purposes only and does not constitute a guarantee, promise of delivery, shipping contract, or professional advice of any kind. You should not rely on estimated stages for any time-sensitive decision.
The Service displays information supplied by merchants, carriers, and other third parties. Order Care does not control, verify, or assume responsibility for the accuracy or completeness of third-party information, and is not a party to any transaction between you and any merchant.
Nothing in these Terms or your use of the Service creates any agency, partnership, joint venture, employment, or fiduciary relationship between you and Order Care, or between Order Care and any merchant beyond a service-provider relationship.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. Order Care does not warrant that displayed information — including estimated timeline stages — is accurate, complete, or current, or that the Service will be uninterrupted or error-free.
To the maximum extent permitted by law, Order Care and its operators, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service. In no event shall the aggregate liability of Order Care for all claims relating to the Service exceed fifty U.S. dollars ($50) or the amount you paid to Order Care in the twelve months preceding the claim, whichever is greater. Order Care is not liable for the acts, omissions, products, shipping performance, or refund decisions of any merchant or carrier.
You agree to indemnify, defend, and hold harmless Order Care and its operators, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Service, your violation of these Terms, or your violation of any rights of a third party.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration shall be conducted in English. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. YOU AND ORDER CARE EACH WAIVE THE RIGHT TO A TRIAL BY JURY.
ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) must proceed in court, and the waiver remains in force for all other claims.
You may opt out of the arbitration and class-waiver provisions by emailing the support address listed on this page within thirty (30) days of first using the Service, stating your name and intent to opt out.
Any claim arising out of or relating to the Service must be filed within one (1) year after the claim arose; otherwise it is permanently barred, to the extent permitted by applicable law.
You may use the Service only to check the status of orders associated with your own email address. You may not: (a) access or attempt to access order information belonging to others; (b) use automated means (bots, scrapers, scripts) to access the Service; (c) probe, scan, or test the vulnerability of the Service; (d) interfere with the Service's operation; or (e) use the Service for any unlawful purpose. We may suspend or terminate access for violations.
The Service, including its design, text, graphics, and software, is owned by or licensed to Order Care and protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works without prior written consent.
The Service processes the order information necessary to display your order status (such as your email address, order number, items, and shipping destination), as provided by the merchant. This information is used solely to operate the Service and is not sold to third parties.
Order Care is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including carrier delays, customs processing, weather, labor disputes, internet or hosting failures, or acts of government.
We may suspend or discontinue the Service, in whole or in part, at any time without notice. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, Arbitration, and Class Action Waiver) survive.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
These Terms constitute the entire agreement between you and Order Care regarding the Service and supersede all prior understandings.
